It has become common sense to claim that "such regulation will target big tech and end the digital Wild West." In this scenario, we often hear regulatory proposals treated as synonyms: AI, digital platforms, social networks, online accountability. Some even propose a universal solution, a new civil code for the digital world, always justifying the fight against a supposed "common enemy.".
\nHowever, the debate has been superficial, lacking clear distinctions between the regulated objects and their effects on different actors. This lack of clarity affects not only the group of companies that have come to be called "big techs"\u2014a concept that, in itself, is problematic\u2014but also Brazilian companies and users.<\/p>\n

This is not about defending impunity or the absence of rules in the digital environment. On the contrary, the objective is to improve the quality of the discussion and encourage greater discernment about the issues and their impacts on Brazilian society, regardless of ideological leanings.<\/p>\n

Without intending to exhaust the subject, I highlight four areas that, although related, require distinct approaches.<\/p>\n

Social networks, generally managed by social media platforms, are at the heart of the debate about fake news and Bill 2630 of 2020. This bill, which did not advance in the Chamber of Deputies, also covered messaging and search engines. Despite its relevance, the lack of consensus among parliamentarians and Brazilian society on a solution regarding whether, how, and which body would regulate so-called disinformation without harming freedom of expression is symptomatic.
\nBill 2768 of 2022, proposed by Congressman Jo\u00e3o Maia, seeks to regulate digital platforms, delegating oversight to Anatel (the Brazilian telecommunications regulatory agency). However, the legal concept of "digital platform" is vague, encompassing everything from marketplaces and social networks to operating systems and cloud computing services. In Brazil, more than 500 platform operators would be affected, including small and medium-sized enterprises, highlighting the difficulty of defining and implementing generic regulations without causing profound market impacts. Furthermore, policymakers have also focused on the competitive aspect, aiming to prevent potential abuses of economic power by large platforms, with recommendations from the Ministry of Finance to strengthen CADE (the Brazilian antitrust authority) and combat possible monopolistic practices.<\/p>\n

The debate on Artificial Intelligence (AI) gained momentum in 2023, driven by ChatGPT. Bill 2338, approved by the Senate and now in the Chamber of Deputies, is comprehensive and would impose high regulatory costs on organizations that use AI. The complexity of the topic requires care to ensure that regulation does not limit technological advances or overburden Brazilian organizations, many of which are already regulated by sectoral or thematic regulators (such as the ANPD, CADE, Senacon, Ministry of Labor, etc.).<\/p>\n

On another front, the recent Supreme Court ruling on liability for content posted by third parties on the internet has brought significant changes that will impact internet use. The Brazilian Internet Bill of Rights (Marco Civil da Internet) generically refers to "application providers," without differentiating between portals, applications, platforms, or social networks. With the Supreme Court's decision, these providers can be held liable for the illegal acts of third parties through simple extrajudicial notification, without the need for a court order, and introducing new concepts such as the "duty of care." This broad scope should lead organizations with portals and applications to adopt conservative stances, limiting freedom of communication to avoid legal harm, in addition to creating high compliance costs for companies that do not have business models focused on social media.<\/p>\n

The debate on digital regulation requires sobriety and clarity from legislators and society. Although the four axes highlighted here are relevant and often confused, they do not exhaust the challenges of the digital universe. However, they represent areas where a lack of distinction between objects and actors can generate confusion and unintended impacts.
\nIt is crucial that the discussion be qualified, analyzing each topic separately and considering its effects on different sectors and actors. Only with a well-founded debate can we build regulatory frameworks that promote innovation, protect citizens, and guarantee the advancement of digital innovation in a competitive and fair manner.<\/p>\n
