On March 6th, in S\u00e3o Paulo, ABES presented its 2026 Regulatory Agenda, with proposals to reorganize the implementation of public policies related to digital transformation in Brazil. Among the main points is the advocacy for a centralized federal structure to coordinate issues such as artificial intelligence, digital infrastructure, and cybersecurity.<\/p>\n

The organization suggests that this governance could be the responsibility of a new ministry or a structure directly linked to the Presidency of the Republic, since the dispersion of these agendas across different areas of government reduces strategic coordination and makes it difficult to define national priorities.<\/p>\n

According to the president of ABES, Andriei Gutierrez, \u201cDigital transformation needs to be treated as a state policy. Brazil has a strategic window to expand its global competitiveness, but this requires strong governance, legal certainty, and adequate incentives for innovation.\u201d.<\/p>\n

Digital governance at the heart of the agenda.<\/strong><\/p>\n

ABES states that the Brazilian digital agenda is currently distributed among different bodies, such as the Ministry of Science, Technology and Innovation, the Ministry of Development, Industry, Trade and Services, and the Ministry of Finance. The organization's proposal is to create a coordination center capable of articulating policies for artificial intelligence, semiconductors, data infrastructure, and technological innovation.<\/p>\n

Marcelo Almeida, director of government relations for the association, stated: \u201cThe idea is to give governance centrality to digital transformation, with the capacity to establish national priorities and goals.\u201d.<\/p>\n

The 2026 Regulatory Agenda was organized into three axes: artificial intelligence, digital infrastructure, and cybersecurity. These themes require coordinated treatment because the advancement of one depends on the development of the others.<\/p>\n

REDATA enters the digital infrastructure arena.<\/strong><\/p>\n

Regarding infrastructure, the association advocates for measures to expand data and processing capacity in the country. In this context, the agenda includes support for the regulation of the Special Tax Regime for Data Centers, REDATA.<\/p>\n

ABES links the issue to the international competition for technological leadership and argues that Brazil needs to adopt instruments to expand its computing base and attract investment. At the same time, it advocates for a digital sovereignty strategy open to international cooperation. Approximately 701% of the software used in Brazil is developed abroad.<\/p>\n

ECA Digital and insecurity in its implementation.<\/strong><\/p>\n

Another highlight is the implementation of the so-called Digital ECA (Statute of Children and Adolescents). The entity believes that the timeframe foreseen for companies to adapt may be insufficient, especially given the need for supplementary guidance from the National Data Protection Authority.<\/p>\n

Luiz Prado, leader of the working group on the topic at ABES, stated: \u201cThe deadline is challenging, especially for smaller companies that do not have the same capacity for adaptation as the large platforms.\u201d.<\/p>\n

Eduardo Paranhos, head of the organization's artificial intelligence working group, also pointed to the risk of regulatory uncertainty. "Without clear guidelines, there is a risk of different interpretations of the rule and a case-by-case application, which can increase litigation and generate legal uncertainty," he said.<\/p>\n

Talent, taxation and public procurement<\/strong><\/p>\n

The association's agenda also includes proposals on professional training, attracting international talent, taxation, data protection, regulation of digital platforms, and the use of public procurement as an instrument for innovation. The goal is to structure a regulatory environment with greater predictability for investments in technology and to accelerate the digitalization of the Brazilian economy.<\/p>","protected":false},"excerpt":{"rendered":"
