Provisional Measure No. 1,318/25, which establishes the Special Regime for Data Center Equipment (REDATA), This is a strategic action to attract robust investments in digital infrastructure to Brazil, with a direct positive impact on the entire digital economy chain.
The conversion of the Provisional Measure into Law is the responsibility of the National Congress, but its regulation is the factor that will accelerate investors' decision-making and initiate the process of consolidating the country as one of the poles of attraction for these computing infrastructures. Brazil has objective conditions such as: renewable energy, communications and energy infrastructure, equipment industry, consolidated market and, from the approval of the Provisional Measure, will also have greater legal certainty.
The joint processing of REDATA with Bill 2.338/23 (Regulation of Artificial Intelligence) will harm both projects: while REDATA deals with tax incentives and physical infrastructure, the regulation of AI demands in-depth debates on rights, responsibilities, intellectual property, and social impacts. These are agendas with distinct timelines and complexities.
While we await the completion of legislative and administrative processes, the country continues to have a significant and growing deficit in the trade balance of Computing and Information services, which by November 2025 stood at US$7.8 billion, compared to a total of US$6.8 billion in 2024. Attracting computing capacity to Brazil will reverse this trend and increase our country's technological autonomy.
Attracting investment in data centers, with the environmental sustainability rules outlined in the Provisional Measure, is a strategic decision that repositions the country on the global stage, generating jobs throughout the digital economy chain and bringing a new perspective on economic development; in other words, it is a decision about the future of Brazil.
Given this scenario, the associations that signed this manifest They request:
1. Immediate establishment of the Joint Committee to review Provisional Measure 1.318/25, ensuring the swift and independent processing of the REDATA, which is valid until February 25th;
2. Definitive separation between the processing of REDATA and PL 2.338/23 (AI Regulation), preserving the technical integrity and the appropriate timing of each initiative;
3. Prioritizing the voting on REDATA in both legislative houses, preventing its expiration and consolidating Brazil as a competitive destination for investments in digital infrastructure.
