Letter of Commitment for the Renewal of the Moratorium on Electronic Commerce at the World Trade Organization (WTO)
To the attention of the Government of the Federative Republic of Brazil,
The signatory associations and entities, through this Letter of Commitment for the Renewal of the Moratorium on Electronic Commerce at the WTO, reaffirm their commitment to defending a predictable, open, and innovation-promoting international digital trade environment.
Since 1998, the moratorium on the application of customs tariffs to electronic transmissions has decisively contributed to the safe expansion of global e-commerce, creating conditions for new business models, productive inclusion, and digital transformation.
We acknowledge that the current moratorium expires in March 2026, and that the WTO has been conducting relevant discussions, both in the Work Programme on Electronic Commerce and in the Joint Declaration Initiative (JSI) on an Agreement on Electronic Commerce, the draft of which is already circulating among Members.
In this context, the undersigned entities consider it essential that:
- Brazil supports the renewal of the moratorium on tariffs for electronic transmissions until a definitive multilateral agreement on electronic commerce is concluded;
- The country should preserve its image as a constructive and predictable player in multilateral negotiations, especially on issues related to the digital economy, innovation, and the internationalization of small and medium-sized enterprises.
We believe that maintaining the moratorium, even provisionally while a multilateral framework is consolidated, avoids the risks of digital fragmentation, preserves the competitiveness of Brazilian exports of digital services, and guarantees a level playing field for companies and consumers.
We reaffirm our joint commitment to technical dialogue and institutional engagement with the Brazilian private sector, offering our collaboration to the competent authorities to support Brazil's position in the WTO discussions leading up to the 14th Ministerial Conference (MC14), scheduled for March 2026.
