The landscape of Intellectual Property in Brazil underwent a significant update with the publication of Ordinance GM/MDIC No. 110/2025 and Ordinance INPI/PR No. 10/2025. These regulations brought with them an adjustment in the fees for services rendered by INPI.

Recently, the scenario of Intellectual Property (IP) in Brazil underwent a significant update with the publication of Ordinance GM/MDIC No. 110/2025 and Ordinance INPI/PR No. 10/2025. These regulations brought with them an adjustment in the fees for services rendered by National Institute of Industrial Property (INPI). For entrepreneurs and C-levels, The message is clear: strategic planning and agility in protecting intellectual assets are becoming even more crucial.
Although the average adjustment in the new fee schedule is around 24%, some services have seen more significant increases. According to INPI itself, the adjustments aim to reduce bureaucracy and optimize processes. In fact, this percentage is much lower than the accumulated inflation (IPCA/IBGE) during the period, especially since the values had not been updated for years.
The significant discounts for micro-enterprises (ME), small businesses (EPP)Individuals, cooperatives, educational and research institutions, and non-profit entities were maintained. In addition, low-income individuals and people with disabilities (PwD) will be offered a discount of 100% applicable to eligible entry services.
The adjustments impacted services related to patents; trademarks; industrial designs; licensing, technology transfer and franchising agreements; geographical indications; integrated circuit topographies and even computer programs (software). These values can be consulted in the INPI's Fee Schedule for services provided (Ordinance GM/MDIC No. 110/2025).
Although the discounts mitigate the impact for a large part of the innovation ecosystem, the point of concern lies in the timeframe. The new values will come into effect on August 7, 2025. This means that companies planning to initiate or continue registration or endorsement processes with the INPI (Brazilian National Institute of Industrial Property) have a window of time to do so at the current rates.
The undeniable importance of registration.
In a competitive market, protecting intellectual property assets is not a cost, but a strategic investment. Registering a trademark, for example, guarantees the exclusive use of the distinctive sign, preventing misuse by competitors and building the value of your brand identity in the market. Similarly, a patent protects an invention, granting the holder the right to prevent third parties from exploiting it without authorization, ensuring a return on the high investment in research and development.
In the current context, software registration takes on crucial importance. Although copyright protection for the source code and structure of computer programs is granted from the moment of their creation, registration with the INPI (Brazilian National Institute of Industrial Property) serves as robust proof of authorship and ownership. In cases of litigation, this registration simplifies proving ownership and creation date, providing greater legal security and market value to your digital asset.
Given the price adjustments, the message for entrepreneurs and C-level executives is clear: anticipation and planning are their greatest allies. Assessing the portfolio of intellectual assets, identifying what needs to be protected, and acting quickly can represent significant savings, as well as strengthen your company's market position. The swift decision to protect your intangible assets will translate not only into short-term cost optimization but also into a long-term competitive advantage.
