
Debate on Tax Reform
THE ABES CONFERENCE 2021 - EXPONENTIAL WAVES AND DIGITAL RESILIENCE, organized in partnership with the portal The Shift, dedicated the second day of the event (09/15) to evaluating tax information proposals, in the afternoon dedicated to the Business Environment in Brazil. The event had platinum sponsorship from Oracle and master sponsorship from Amazon Web Services (AWS), IBM, Sky.One Solutions, TOTVS and CAESBRA.
The thematic panel brought renowned leaders to talk about the urgency of tax reform for the current market moment. For Jorge Sukarie, VP of ABES' Deliberative Council, “our legal uncertainty is so great that even if we opt for a more conservative option, when it comes to paying taxes, we are still not absolutely sure that it was the best option for our Business". For the executive, it is difficult to consider that the current Tax Reform projects and the Income Tax Bill will bring the simplification of the system and the necessary legal security.
In the assessment of Ana Claudia Akie Utumi, a partner at Utumi Advogados, the Brazilian tax bureaucracy is still very complex, “companies in Brazil take longer to fulfill their obligations than in other countries”. She pondered that "no part of the Constitution has been as reformed since 88 as the tributary one, but always to add complexity" and that PL 2337, of the IR, which supposedly would come to reform the income tax and to improve the business environment, will, in fact, bring “more confusion is more complexity, more uncertainty and more tax burden”.
According to Washington Coelho, Tax Partner at EY, tax reform is necessary, but the entire process is very difficult. “The obligations are complex because the system is complex”, says the executive. He assesses that the tax reform proposals will significantly increase the tax burden on the services sector, which should increase the price of the sale of IT services, especially for individuals, private schools, governments, etc. “We need to have a simple system, we cannot continue with the concepts of cumulative and non-cumulative, single-phase, among others, as it generates all the complexity. We need to have few systems working, but with an adequate weight of tax burden on each in each segment”, he pointed out.
